BRILUMD® – Official Limited Warranty Policy
Effective Date: October 15, 2024 Applies To: All BRILUMD® LED lighting products (“Products”) purchased from the Company or its authorized resellers within the Republic of the Philippines.
Article 1: Limited Warranty Coverage
BRILUMD® (“the Company”) warrants its Products against defects in materials and workmanship under normal use and service conditions.
- 1.1. Warranty Period: This Limited Warranty extends for a period of One (1) Year from the original date of purchase as indicated on the proof of purchase.
- 1.2. Scope of Coverage: This Warranty covers defects in LED chips, drivers, electronic components, and housing integrity arising from the manufacturing process.
Article 2: Exclusions and Limitations
This Limited Warranty is void and shall not apply to any Product damage or failure resulting from:
- Improper installation, negligence, abuse, misuse, or any application not in accordance with the Product’s intended use and instruction manual.
- Unauthorized alteration, modification, or repair performed by non-Company personnel.
- Force majeure events including, but not limited to, lightning strikes, power surges, abnormal voltage, fire, floods, or other acts of God.
- Normal wear and tear, including gradual lumen depreciation (brightness reduction) and minor color shifting, which are characteristic of LED technology.
- Damage incurred during shipment, which must be addressed under the Shipping and Returns Policy.
- Consumable parts, such as batteries or fuses, unless explicitly covered.
Article 3: Warranty Claim Procedure
To initiate a claim under this Limited Warranty, the original purchaser (“Purchaser”) shall:
- Contact BRILUMD® Customer Support within the Warranty Period with a detailed description of the defect.
- Provide a valid, original proof of purchase (e.g., official receipt or sales invoice) from an authorized seller. Failure to provide such proof may result in the denial of the claim.
- Comply with the Company’s instructions, which may include providing photographic evidence of the defect or returning the Product for inspection. If a return is required, a Return Merchandise Authorization (RMA) number will be issued.
Article 4: Remedies
In the event a defect is verified and covered by this Warranty, the Company shall, at its sole discretion and as its sole obligation, provide one of the following remedies:
- Repair: Repair the defective Product using new or refurbished parts of equivalent quality.
- Replace: Replace the defective Product with an identical or substantially equivalent product.
- Refund: Issue a refund of the original purchase price. The Company reserves the right to prorate the refund based on the remaining warranty period.
Any repair or replacement of a Product shall not extend or renew the original Warranty Period. The remedy chosen by the Company shall constitute the Purchaser’s exclusive remedy under this Warranty.
Article 5: Disclaimer and Limitation of Liability
- 5.1. Disclaimer: EXCEPT FOR THE EXPRESS LIMITED WARRANTY STATED HEREIN, THE COMPANY DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
- 5.2. Limitation of Liability: THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OR INABILITY TO USE THE PRODUCT. THE COMPANY’S TOTAL LIABILITY UNDER THIS WARRANTY IS LIMITED TO THE ORIGINAL PURCHASE PRICE OF THE PRODUCT.
- 5.3. Consumer Rights: This Warranty provides specific legal rights. The Purchaser may also have other rights under the Consumer Act of the Philippines (R.A. 7394), and this Warranty does not affect those statutory rights.
Article 6: Governing Law and Dispute Resolution
This Limited Warranty Policy shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising hereunder shall be submitted to the exclusive jurisdiction of the competent courts of the City of Santa Rosa, Laguna, Philippines.
